THIS AGREEMENT CONTAINS ARBITRATION AND CLASS ACTION WAIVER PROVISIONS THAT WAIVE YOUR RIGHT TO A COURT HEARING, RIGHT TO A JURY TRIAL, AND RIGHT TO PARTICIPATE IN A CLASS ACTION. ARBITRATION IS MANDATORY AND IS THE EXCLUSIVE REMEDY FOR ANY AND ALL DISPUTES UNLESS SPECIFIED BELOW OR IF YOU OPT OUT.

Tandem Vincemus sells fine-art wall pieces, including aluminium (metal) prints and canvas prints. Each piece is made to order — printed and quality-checked individually before dispatch. We make every effort to display the colours and details of our artwork accurately, but we cannot guarantee that your screen's display is accurate, and slight variation between the on-screen image and the finished piece is normal.

4. General Conditions and User Conduct

All aspects of our Website are protected by U.S. and international copyright, trademark, and other intellectual property laws. You agree not to use the Website in any unlawful manner, including but not limited to: hacking or digital attacks; publishing abusive, vulgar, or defamatory material; violating applicable laws or regulations; infringing intellectual property rights; submitting false or misleading information; or uploading malicious code.

Tandem Vincemus reserves the right to terminate your access to the Website if you do not comply with these Terms, provide false information, or engage in any conduct that harms Tandem Vincemus's rights or interests.

5. Intellectual Property & Personal Use

All artwork, designs, images, and content on the Website are owned by or licensed to Tandem Vincemus and protected by applicable intellectual property laws. Products purchased from Tandem Vincemus are for your personal, non-commercial use only. You may not copy, reproduce, resell, redistribute, or create derivative works from any artwork or content without our prior written consent. We reserve the right to limit or prohibit orders that appear to be placed for resale or distribution.

6. Payment

By submitting payment information, you represent that you are authorised to use that payment method, that all information provided is accurate and complete, and that sufficient funds exist to cover the amount due.

7. Order Placement and Acceptance

Your order confirmation does not signify our acceptance of your order. We reserve the right to accept or decline any order for any reason. Because pieces are made to order, please contact us at hello@tandemvincemus.com as soon as possible if you need to modify or cancel an order before it enters production.

8. Shipping & Delivery

An accurate shipping address and contact number are required. We are not responsible for missing or delayed shipments caused by incorrect address information provided at checkout. Delivery confirmation provided by the carrier is deemed sufficient proof of delivery, even without a signature. Full details are set out in our Shipping Policy.

9. Returns, Refunds & Warranty

10. Disclaimer of Warranties

Except for the express Lifetime Warranty and guarantees stated in our Returns & Refunds policy, and except where prohibited by law, this Website and all products are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. We make no representations or warranties as to the reliability, timeliness, quality, suitability, accuracy, or completeness of any information on this Website.

11. Limitation of Liability

EXCEPT WHERE PROHIBITED BY LAW, IN NO EVENT SHALL TANDEM VINCEMUS OR ANY OF ITS OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR OTHER DAMAGES ARISING FROM OR RELATED TO THIS AGREEMENT, THE PRODUCTS, OR YOUR USE OF THE WEBSITE. IF TANDEM VINCEMUS IS FOUND LIABLE UNDER ANY THEORY, LIABILITY WILL BE LIMITED TO THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.

12. Dispute Resolution — Mandatory Binding Arbitration

You agree that any dispute or claim arising from or relating to these Terms, our Privacy Policy, our marketing practices, or our products shall be submitted to binding, final, and confidential arbitration before a single arbitrator administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

You may opt out of arbitration within 30 days of your purchase by emailing hello@tandemvincemus.com with your name, the product purchased, and your intent to opt out.

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Tandem Vincemus and its affiliates from and against any and all claims, losses, liabilities, damages, expenses, and costs arising out of your breach of these Terms or your violation of any law or the rights of a third party.
